A licence is required for an HMO if it is required under mandatory licensing, additional licensing or selective licensing.
Currently, only HMOs that are not self contained flats (although an individual flat could in theory require a licence) have five persons or more occupying and three storeys or more etc. (see "do I require a licence" for more info)
