New legislation has been published that introduces new management of HMO regulations for section 257 HMOs and it is The Licensing and Management of Houses in Multiple Occupation (Additional Provisions) (England) Regulations 2007
Section 257 HMOs are certain converted blocks of flats. Essentially, if the conversion works do not comply with at least the Building Regulations 1992, then the building will be a section 257 HMO.
The legislation also brings in the power for a local authority to designate an area to require this type of HMO under licensing.
The legislation takes effect from 1st October 2007.
All landlords will be required to follow the management regulations part of the new legislation. The licensing part will only apply if the local authority designate an area for the purposes of additional licensing.
